Society needs to be educated that man’s chromosomes decide child’s gender, say Delhi HC

KV Prasad Jun 13, 2022, 06:35 AM IST (Published)

Listen to the Article (6 Minutes)

Summary

The court said the notion that a woman”s value diminishes if her parents cannot fulfil dowry expectations of her husband and in-laws reflects a deep-seated bias and discrimination against women.

Parents who give their daughter-in-laws a hard time for not being able to fulfil their desire of “preserving their family tree”, need to be educated that it is their son and not his wife whose chromosomes will decide the child’s gender, the Delhi High Court has observed.

The high court, which was dealing with a case of dowry death of a woman after being allegedly harassed by her husband and in-laws for bringing insufficient dowry and giving birth to two daughters, said in contemporary times, the idea of a woman’s worth being tied to material considerations contradicts the principles of equality and dignity.

“The persistent prevalence of regressive mindsets and instances exemplified by cases involving insatiable demands for dowry underscores a broader societal concern. It highlights the challenges faced by married women, whose intrinsic value and dignity should not be contingent upon their parents’ ability to meet the insatiable financial demands from their in-laws,” Justice Swarana Kanta Sharma said.

The high court said it is disturbing to witness a scenario where parents wish for the well-being of their daughter and her comfort after she leaves her paternal house and tries to settle in the matrimonial home but instead of providing her love and support, the new bride is met with unrelenting greed and harassment from in-laws family.

It said the trauma is multiplied and becomes lifelong when the victim of a dowry-related offence gives up her life due to constant torture and harassment, especially when the two daughters she has given birth to and loved also become a ground to harass and traumatise her as if she is solely responsible for the child’s gender.

“Surprisingly, the genetic science in this regard is ignored according to which, the genetic determination of gender of the unborn child when the child is conceived, involves the combination of X and Y chromosomes, with females possessing two X chromosomes (XX) and males having one X and one Y chromosome (XY). According to Encyclopedia Britannica, the outcome of fertilisation depends on whether an unfertilised egg fuses with a sperm carrying an X or Y chromosome, resulting in the birth of a girl or boy, respectively,” the high court said.

It said the court had dealt with numerous cases of harassment, nagging and suicide or dowry deaths due to the victim being victimised for giving birth to daughters after being constantly harassed over not being able to fulfil her husband and in-laws’ desire of “preserving the family tree”.

Justice Sharma said the court is “constrained to observe that such people need to be educated that it is their son and not their daughter-in-law whose chromosomes through the union of a married couple will decide the gender of their child”.

“Even if this judgement becomes the birthplace of such enlightenment, it will go a long way to change the mindsets of perpetrators of such crimes and save lives of innocent married women, by using principles of science through principles of law,” she said.

The high court made the observations while denying bail to the husband in a dowry death case. The allegations against the accused were that he along with his family members used to torture his wife for dowry leading to her committing suicide.

It has been alleged by the complainant, father of the deceased woman, that the accused and his family pressured his daughter for additional dowry and financial demands, causing significant distress. It has also been alleged by him that she was taunted and mistreated for giving birth to two daughters.

The high court, in its order, said prima facie at this stage, a woman has lost her life for giving birth to daughters, which should be unacceptable to a conscientious society and such offences have to be considered grave and serious when the trial is yet to begin.

“In view of the above facts and circumstances, and since the allegations against the present applicant/accused are grave and serious in nature, the charges are yet to be framed and the material witnesses are yet to be examined, this court is not inclined to enlarge him on bail,” it said.

The court further opined that in a society that emphasises equality and strives for equal progress of women and women empowerment, incidents like this are etched as disheartening markers on the path of equal societal advancement for women.

It said the notion that a woman”s value diminishes if her parents cannot fulfil dowry expectations of her husband and in-laws reflects a deep-seated bias and discrimination against women.

Such expectations not only violate the principles of gender equality but also contribute to an environment where women are objectified and reduced to mere transactions, the court said while acknowledging the profound distress experienced by parents, who in the earnest pursuit of their daughter’s happiness, bestowed everything they had to allegedly fulfil the dowry demands of her in-laws.

Kerala doctor arrested after fiance kills self over exorbitant dowry demand

Summary

A government post graduate doctor was arrested here on Thursday for allegedly abetting the suicide of his woman colleague after backing out from their marriage proposal due to dowry. The Medical college police here picked up R E Ruwais from his home in Karunagappally early today and later recorded his arrest following a detailed interrogation.

A government post graduate doctor was arrested on Thursday, December 7, for allegedly abetting the suicide of his woman colleague after backing out from their marriage proposal due to dowry. The Medical college police in Thiruvananthapuram picked up RE Ruwais from his home in Karunagappally early today and later recorded his arrest following a detailed interrogation.

In the wake of the developments, he was suspended by the medical college principal, state health minister Veena George’s office said. This is a “serious issue” that cannot be accepted at any cost, the minister said in a statement today. A post graduate student in the ortho department of the Government Medical College here, Ruwais was apprehended two days after Dr Shahana, his college mate and friend was found dead in an apartment in the state capital.

The 26-year-old medico was found unconscious in her apartment and later declared brought dead at the hospital on Tuesday. Her family alleged that Shahana took the extreme step as she was depressed due to the exorbitant dowry demand by Ruwais and his relatives.

A senior police officer said he was taken into custody based on their statements and a suicide note purportedly written by the victim which was recovered from her apartment. “His arrest was recorded. Sections of abetment to suicide and Dowry Prohibition Act were slapped against him,” the police officer told PTI.

In the purported suicide note, there were indications about the dowry issue and the mental trauma she was undergoing, he added. The officer said that the accused has not yet confessed to the crime. “We have collected evidences, including the suicide note, which will be submitted before the court,” he added. Ruwais is a popular leader among the post-graduate medical students here and was the President of the PG Association (Medical College unit). He was removed from the post after the dowry allegations cropped up, office bearers of the association said.

Meanwhile, Shahana’s brother Jasim Nas told the media that Ruwais and his family – especially his father – were adamant about getting huge dowry. Though he had assured them that he was ready to give them as much money he could, they were not ready for a compromise and backed out from the marriage which had devastated his sister, Nas said.

“Ruwais finally told her that money was more important to him, which shocked Shahana,” he said. Some of her friends also told reporters that Shahana was depressed due to the dowry issue.

Reacting on the matter, Chief Minister Pinarayi Vijayan said that young women should be encouraged to reject proposals where dowry demands are made, and that public opinion has to change with regard to the practice. “If someone demands dowry, they (women) should be able to strongly reject such proposals. Society and families need to support them for that,” he said in Kochi.

On Wednesday, the government had ordered a probe into the death of Shahana after allegations of dowry related issues causing the suicide cropped up. Health Minister George directed the director of the Women and Child Development Department to probe this issue, submit a report and take stringent actions.

The state Minority Commission also intervened into the issue and initiated a case on its own based on media reports. Its Chairperson A A Rasheed directed the district collector, city police commissioner and director of medical education to appear before the Commission during its next sitting on December 14 and submit a report on the incident. State Women’s Commission Chairperson P Sathidevi visited Shahana’s residence in nearby Venjaramoodu and consoled her mother on Wednesday. The victim’s father, who was working in the Middle East, died recently.

Expressing grief and concern over the alleged suicide of the young doctor, Sathidevi said stringent measures should be taken if the mental agony caused due to dowry had forced her to take the extreme step.

Kota coaching centres can now take routine tests but these conditions apply

KV Prasad Jun 13, 2022, 06:35 AM IST (Published)

Listen to the Article (6 Minutes)

Summary

Kota district administration has amended its previous order on banning tests in coaching centres for two months and issued six new directives aimed at regulating these tests and ensuring the well-being of students.

Amidst rising student suicide cases in Kota, the district administration banned examinations at coaching centres in Kota in August for two months to provide mental support and security to the students staying there. Now, the administration has amended and issued six new directives aimed at regulating these tests and ensuring the well-being of students.

District Collector O P Bunkar, in a recent order, announced the immediate lifting of restrictions on routine tests in coaching institutes, as reported by PTI.

The new directives specify that coaching institutes must implement a 21-day gap between tests for students enrolled in regular courses. Additionally, students should be granted a day off following a test. For students who have completed their courses, a seven-day gap between tests is recommended.

Importantly, participation in routine tests will not be mandatory. Test results will only be disclosed after a waiting period of three days. The results will be communicated individually to students and separately to their parents, with strict instructions not to display them publicly.

Following each test, a performance evaluation session will be conducted for students. Moreover, coaching institutes are required to organise counselling sessions for students who receive below-average marks.

Additionally, the Ministry of Education (MoE)  on Tuesday released a, draft with recommendations for schools on how to improve their sensitivity, understanding, and support in the event of suspected self-harm. Read here

World Suicide Prevention Day: A look at suicide rate in India

KV Prasad Jun 13, 2022, 06:35 AM IST (Published)

Listen to the Article (6 Minutes)

Summary

The majority of suicides were reported in Maharashtra, Tamil Nadu, Madhya Pradesh, West Bengal, and Karnataka, as these five states accounted for a huge 50.4 percent of suicide cases recorded in the country.

The World Suicide Prevention Day (WSPD) is observed on September 10 every year and raises awareness about the far-reaching consequences of suicides. According to World Health Organization (WHO) estimates, more than 700,000 suicides are registered worldwide every year.

This World Suicide Prevention Day also serves as a reminder that preventing suicides is a public health priority, and urgent actions are required to curb the increasing suicide rates. This day is an occasion to raise awareness about the mental health issues that could be behind suicides and the far-reaching consequences of taking one’s own life on one’s own family and society at large.

World Suicide Prevention Day: History, theme and significance

The World Suicide Prevention Day theme for 2021-2023 is “Creating Hope Through Action,” which promotes the initiative to take action and create hope for those having suicidal thoughts. It’s a powerful call to action and encourages people to understand that there are various options to consider apart from committing suicide. Therefore, people can help those with suicidal thoughts by lightening up their mood and making even the smallest efforts possible to help them.

The combined efforts of the International Association for Suicide Prevention (IASP) and the World Health Organization (WHO) resulted in this day being established as a global observance. The day was established following WHO’s 1999 campaign for preventing suicides worldwide.

On this day, IASP, WHO, and the World Federation for Mental Health (WFMH) organise events to spread awareness about the societal stigmas that lead to suicidal thoughts and behaviour. This helps in early identification of such problems so that proper help can be provided. Therefore, World Suicide Prevention Day plays an important role in the initiative to curb the increasing suicide rates in the world.

Suicide rate in India

According to the August 2022 data released by the National Crime Records Bureau (NCRB), a total of 1.64 lakh suicides were registered in India in 2021. The numbers are shocking as they show a significant increase of 6.1 cases per one lakh population compared to the 2020 figures. The suicide rate in India in 2021 was recorded at 12 per one lakh population as against the rate of 11.3 per one lakh population in 2020.

Moreover, this data is the highest since the start of reporting of suicides by the NCRB in 2021, and it’s a matter of serious concern. The majority of suicides were reported in Maharashtra, Tamil Nadu, Madhya Pradesh, West Bengal, and Karnataka, as these five states accounted for a huge 50.4 percent of suicide cases recorded in the country.

Most of these suicides were fueled by the economic downturn during and after the COVID-19 pandemic. Several factors like pay cuts, layoffs, and uncertain income spurred male suicides. The male-to-female ratio of suicide victims stood at 72.5 as against 27.4, respectively, which was significantly higher compared to 2020’s ratio of 70.9 against 29.1.

Suicide major contributor to unnatural deaths in Indian prisons, says SC committee

KV Prasad Jun 13, 2022, 06:35 AM IST (Published)

Listen to the Article (6 Minutes)

Summary

The apex court-appointed committee, headed by former top court judge Justice (retd) Amitava Roy, has said that out of the 817 unnatural deaths, 660 were suicides with Uttar Pradesh recording the highest number of suicides at 101 during this period.

Suicide is a major cause of the 817 unnatural deaths reported in jails across the country between 2017 and 2021, the Supreme Court Committee on Prison Reforms has told the apex court while emphasising the need for building suicide-resistant barracks.

The apex court-appointed committee, headed by former top court judge Justice (retd) Amitava Roy, has said that out of the 817 unnatural deaths, 660 were suicides with Uttar Pradesh recording the highest number of suicides at 101 during this period.

“There is a need to identify potential hanging and anchoring points within the existing designs of prison infrastructure and to build suicide resistant cells/barracks with the use of collapsible material to replace the former,” the committee has said in the final synopsis of reports submitted in the apex court.

The final synopsis of reports dated December 27, 2022, contains nine chapters, including on unnatural deaths in prisons, death row convicts and violence in Indian jails.

In September 2018, the top court constituted a three-member committee headed by Justice (retd) Roy to look at issues involving jail reforms and make recommendations on several aspects, including overcrowding in prisons.

In the chapter titled “unnatural deaths in prisons”, the committee has said torture in custody or custodial death flouts the basic rights of citizens and is an “affront to human dignity”.

It said the report is based on data provided within the Prison Statistics India (PSI) report from 2017 to 2021, published by the National Crime Record Bureau (NCRB).

“The committee analysed PSI data pertaining to deaths (natural & unnatural) in India’s prisons and observed that the number of custodial deaths has seen a steady rise since 2019, and 2021 has recorded the highest number of deaths so far, suicide (80 per cent) being the major cause of unnatural deaths,” the report said.

It said in five years starting from 2017 to 2021, there were 462 deaths on account of old age and 7,736 prisoners died due to illness.

“Out of a total number of 817 unnatural deaths in India’s prisons between 2017-2021, there were 660 suicides and 41 murders in the prisons across India during last five years from 2017 to 2021,” it said.

The committee said 46 deaths were related to accidental deaths during this period whereas seven prisoners each died due to assault by outside elements and negligence or excess by jail personnel respectively.

“Uttar Pradesh has recorded highest number of suicides (101) in the country during the last five years i.e., from year 2017 to 2021 followed by the states of Punjab and West Bengal where 63 and 60 prisoners committed suicide respectively. Amongst Union Territories, Delhi recorded the highest 40 suicides during the last five years from 2017- 2021,” it said.

The committee has recommended that as far as possible, the production of senior citizens and sick prisoners in courts should be done through video-conferencing medium.

“Suicide is a major cause of unnatural deaths among prisoners. The jail staff must be trained to recognise warning signs and must devise appropriate mechanisms to safeguard life in prisons,” it said.

The committee said the jail staff should be regularly provided with the requisite training to recognise “signs of depression and aberrant behaviour”, which may include suicidal intent and should mandatorily provide psychological first aid to prisoners as per their requirements.

It said a consistent and well-researched model of suicide treatment should be developed and implemented in prisons across the country.

The committee said every prison must have a “suicide prevention program” starting from identification to medical treatment so that any such possibility can be thwarted.

“When an inmate at risk is identified by staff, or co-inmates, such identified inmate must be referred to the mental health unit for immediate evaluation and necessary intervention,” it said.

It said prison administration should take immediate and effective measures to prevent violence among prisoners.

“In order to reduce violence in prisons, it is recommended that there should be segregation in prisons amongst first time offenders and repeat offenders, in jails, hospitals and during their transit to courts and other places,” the committee said.

“Prison administration should strive to comprehensively implement national and state health insurance schemes such as the Ayushman Bharat scheme, Chiranjeevi Health Insurance Scheme and similar state health insurance schemes in prisons,” it said.

In a slew of recommendations, it further suggested the need for a robust grievance redressal mechanism for the prisoners to register their complaints.

The apex court is seized of a matter related to conditions prevailing in 1,382 prisons across India. The matter is scheduled to be taken up for a hearing on September 26.

Kota suicide count rises to 22, coaching institutes banned from conducting exams for two months

KV Prasad Jun 13, 2022, 06:35 AM IST (Published)

Listen to the Article (6 Minutes)

Summary

Two NEET aspirants in Kota, Rajasthan, reportedly took their lives in separate incidents on a single day within four hours. After this examinations at coaching centres in Kota have been banned for two months to provide mental support and security to the students staying there.

Two NEET aspirants in Kota, Rajasthan, reportedly took their lives in separate incidents on a single day within a span of four hours. This has brought the total number of such incidents to 22 this year, as per local authorities reported by PTI.

The first case is of an aspirant aged 17, who jumped from the sixth floor of his coaching institute’s building around 3:15 pm. This occurred shortly after he had completed a test and left a room on the third floor of the institute.

Around four hours later, another aspirant who was 18 years old was found dead after hanging himself in his rented residence around 7 pm.

The first aspirant had been preparing for the NEET UG exam for three years meanwhile the other hailing from Bihar’s Rohtas district, had been studying for the NEET UG exam at a coaching institute in Kota for a year.

According to the authorities, no suicide notes were found in the students’ rooms.

After this, examinations at coaching centres in Kota have been banned for two months to provide mental support and security to the students staying there. According to a notice issued by the Zilla Collector of Kota, coaching centres have been asked to halt tests, reported ANI.

Additionally the Kota hostel administration had earlier ordered all hostels and paying guests to install spring-loaded fans in rooms and “anti-suicide nets” to prevent students from taking any extreme step. According to hostel owners, such steps would make their premises “suicide-proof.”

Notably, the Rajasthan government said earlier this year it was planning to introduce the Rajasthan Coaching Institutes (Control and Regulation) Bill with an aim to reduce academic pressure and mandate guidelines for the mushrooming coaching institutes. That Bill is on the back burner now, as per reports.
