Union Minister Rajeev Chandrasekhar sends legal notice to Shashi Tharoor over defamatory remarks

Union Minister of State for Information Technology and Electronics Rajeev Chandrasekhar has sent a legal notice to Congress MP Shashi Tharoor accusing him of making defamatory statements against the BJP leader on a TV channel recently.

Chandrasekhar, who is facing off against Tharoor in the Thiruvananthapuram Lok Sabha constituency in the upcoming polls on April 26, has alleged that the Congress MP disseminated “patently false information” regarding bribing of key voters and influential figures such as parish priests, among others, by the BJP leader.

The notice has claimed that the statements by Tharoor were made with an intent to harm Chandrasekhar’s reputation and image and that his remarks also disrespected the entire Christian community of Thiruvananthapuram and its leaders by accusing them of engaging in cash-for-votes activities.

It has also contended that the Congress MP’s statements violated the Model Code of Conduct (MCC).

The notice also claimed that the statements were also targeted at injuring the BJP leader’s election campaign and benefitting Tharoor in the 2024 Lok Sabha polls.

The legal notice to the Congress leader has sought that he “immediately withdraw” all the allegations made against Chandrashekhar on April 6, tender an unconditional public apology to him on print and electronic media and to “cease, refrain and desist from defaming, harassing, hampering the reputation” of the minister in the future.

It has warned that failure to comply with the stated conditions within 24 hours of receipt of the notice would initiate appropriate criminal and civil proceedings in a competent court of law.

EC asks CBDT to verify Rajeev Chandrasekhar’s poll affidavit details following Congress complaint

The Election Commission on Tuesday directed the Central Board of Direct Taxes (CBDT) to verify any mismatch in affidavit details submitted by Union minister and BJP candidate from Thiruvananthapuram Lok Sabha seat Rajeev Chandrasekhar, sources said.

The Congress had moved the poll panel claiming a mismatch in actual and declared assets in the affidavit filed by Chandrasekhar, who is in the fray against former UN diplomat Shashi Tharoor.

According to procedure, the EC has directed the CBDT to verify any mismatch in affidavit details submitted by Chandrasekhar, the sources said. Any mismatch and falsification of affidavit is dealt with under Section 125 A of the Representation of the People Act 1951, they said.

As per the law, concealing any information in nomination papers or affidavit is punishable with imprisonment for a term which may extend to six months, or with a fine, or both.

Lok Sabha elections 2024: Palakkad to Wayanad, key seats in Kerala

The Bharatiya Janata Party (BJP), which has struggled to win any seats in Kerala, hopes to make a breakthrough in the 2024 Lok Sabha elections.

The 2024 Lok Sabha elections will take place in seven phases, starting on April 19 and concluding on June 1. The Election Commission of India said that the votes will be counted on June 4. Polling for Kerala’s 20 Lok Sabha seats will be held on April 26, per the schedule released on March 16. The voting in Kerala, like the previous general elections, will take place on a single day to avoid conflicts with Vishu, Thrissur Pooram and Eid-ul-Fitr.

The Bharatiya Janata Party (BJP), which has struggled to win any seats in the southern state, hopes for a breakthrough in the 2024 Lok Sabha elections. The state is one of the few that consistently supports Congress and is well-known for its strong left-leaning politics.

The United Progressive Alliance (UPA), led by the Congress, won 19 of Kerala’s 20 seats by a wide margin in 2019. The National Democratic Alliance, led by the BJP, formed a government in the Centre but was unable to win any seats there. Nonetheless, the saffron party secured almost 15% of the vote. It’s interesting to note that the Left Democratic Front (LDF), which had been in power, suffered a severe setback and only won one seat in the elections.

Here are the key seats to watch out for in Kerala:

  1. Palakkad

Palakkad is a high-priority constituency for the BJP in Kerala since it is the only municipality where the BJP holds a clear majority. In 2019, Congress candidate VK Sreekandan won the seat against all odds by over 11,000 votes against the sitting Communist Party of India (Marxist) MP MB Rajesh.

Sreekantan is once again in the fray. Challenging him is A Vijayaraghavan, a member of the CPI(M) Politburo, who is married to the state’s minister of higher education, R Bindu, for the LDF. Krishnakumar, the BJP’s state general secretary, is running for Lok Sabha from Palakkad for the second time.

  1. Thrissur

Actor-politician Suresh Gopi, who ran an unsuccessful campaign from Thrissur in the 2019 Lok Sabha elections, is once again fighting on a BJP ticket. He will face Congress candidate K Muraleedharan, the sitting MP from Vadakara and son of the late chief minister K Karunakaran.

Muraleedharan, the four-time MP and two-time MLA, is known for winning tough contests, including the Vattiyoorkavu Assembly constituency in Thiruvananthapuram and the Vadakara Lok Sabha seat.

The majority of Christian voters in the constituency — over 30% — will be crucial in determining the outcome in this constituency.

  1. Thiruvananthapuram

One of the most high-profile seats in not just Kerala but across the country, Thiruvananthapuram will see a three-cornered battle between three-time MP Shashi Tharoor, former CPI MP Pannyan Raveendran and Union Minister Rajeev Chandrashekhar.

Kerala’s capital city has either supported the Congress or the Communist Party of India (CPI). The closest the BJP got to winning the seat was in 2014 when Olanchery Rajagopal lost to Shashi Tharoor by a vote count of 15,470.

Shashi Tharoor ran in the 2019 elections against Kummanam Rajasekharan of the BJP. Rajasekharan lost to him by a total of 99,989 votes. Tharoor received 41.19% of the vote, compared to 31.30% for the BJP candidate.

CPI’s C Divakaran garnered 2,58,556 votes, or 25.60% of the total.

  1. Pathanamthitta

The Pathanamthitta Lok Sabha constituency is also expected to see a three-way contest in the 2024 general elections, with the BJP fielding veteran Congress leader AK Antony’s son Anil Antony. The Congress party is sticking with Anto Antony, the sitting MP. The CPI-M has fielded former state finance minister Thomas Isaac.

Since the 2009 general elections, voters in the Pathanamthitta Lok Sabha seat have shown steady and continuous support for Congress candidate Anto Antony.

In 2019, Anto Antony defeated BJP’s K Surendran and CPM’s Veena George by 380,927 votes.

  1. Kasargod

From Kasargod, the BJP has fielded ML Ashwini, a Manjeshwar block panchayat member, in place of BJP national office bearer PK Krishnadas and state president K Surendran. Rajmohan Unnithan, the sitting Congress MP, is seeking re-election from the seat. M V Balakrishnan, district secretary of the CPI(M), has been put out by the LDF as their candidate.

With 474,961 votes, Unnithan was victorious from the Kasaragod seat in the 2019 elections. With 434,523 votes, CPM’s KP Satishchandran finished in second.

The Indian Union Muslim League (IUML), a Congress alliance partner, is an essential player in the constituency where religious and linguistic minorities typically determine election outcomes.

  1. Wayanad

The Wayanad Lok Sabha seat will be one of the most closely monitored seats in the upcoming Lok Sabha election. The seat is supposedly safe for Congress because sitting MP Rahul Gandhi is seeking re-election from here.

In the 2019 general elections, Congress won a record 64.9% of the votes, while the CPI(M) received just 25.2%.

The wife of CPI(M) General Secretary D Raja, Annie Raja, will square up against Rahul Gandhi. The Congress and the CPI(M) have decided to go solo in the Kerala Lok Sabha elections, despite the two parties being part of the INDIA alliance.

Google vs Startups: Telcos body accuses tech giants of bias against Indian firms

Indian startups facing delisting threats by Google Play Store have found support from Indian telecom companies. The industry body, Cellular Operators Association of India (COAI), has issued a statement stating, “Global behemoths seem fully prepared to oust the homegrown Indian companies based on pure financial motives.”

Without directly referring to Google, the COAI statement said that no regard was shown to the vital ecosystem of Indian startups, which brings innovation and entrepreneurship to the fore. Importantly, the COAI statement also alleged that such behaviour by “large behemoths” would be against the spirit of the Indian govt’s flagship “Make in India” initiative.

The COAI took the opportunity to flag its long-standing demand for larger internet players like Google to pay telcos compensation. Telcos have been claiming that the traffic generated by such large players, or “Large Traffic Generators” (LTGs), puts a significant burden on telecom networks, requiring vast infrastructural spending. Telcos have cited this as grounds for seeking “fair share” compensation from LTGs.

The COAI statement said that the same LTGs vehemently opposed the proposal for a fair-share contribution for the additional infra costs that Telcos bear. The statement clarified that Telcos are seeking this compensation only from 4-5 LTGs, and not the Indian startup ecosystem.

The statement from COAI comes even as Google restored most apps originally delisted on March 1. Google, in a blog post, had cited non-compliance with its payment policy as grounds for delisting the apps. The delisting had invited comments from the Union Minister for Electronics and Information Technology (MeitY), and Telecom, Ashwini Vaishnaw. Google and startups have met Vaishnaw and Minister of State, MeitY, Meity Rajeev Chandrasekhar. Both ministers have expressed concern about the delisting of Indian Startups.

Google’s statement

A Google spokesperson said, “In the spirit of cooperation, we are temporarily reinstating the apps of the developers with appeals pending in the Supreme Court. Google maintains its right to implement and enforce its business model, as established in various courts. We will invoice our full applicable services fees in the interim and are extending payment timelines for these companies. We look forward to a collaborative effort to find solutions that respect the needs of all parties.”

India’s Minister of State for IT dispels fear of an AI licence raj

In a move aimed at regulating the deployment of artificial intelligence (AI) models within India, the Union Ministry of Electronics and Information Technology (MeitY) issued an advisory to platforms and intermediaries on Friday. The advisory mandates explicit permission from the central government before launching AI models, especially those under testing.

This advisory comes over two months after a previous directive in December, which focused on addressing the issue of deepfakes within social media platforms, urging compliance with existing IT rules.

According to the advisory, any deployment of AI models, software, or algorithms, particularly those still under testing, must obtain explicit permission from the government. Furthermore, platforms are required to label the potential fallibility or unreliability of the generated output and implement a ‘consent popup’ mechanism to inform users about such risks.

Taking to X (formerly Twitter), Minister of State for Electronics and IT, Rajeev Chandrasekhar, simplified the advisory, saying that it is aimed at significant platforms and that permission seeking from the MeitY is only for large platforms and will not apply to startups.

“The process of seeking permission, labelling & consent-based disclosure to a user about untested platforms is an insurance policy for platforms who can otherwise be sued by consumers,” he added.

Highlighting concerns over intermediaries’ failure to fulfill their due diligence obligations under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the advisory highlights the prevention of hosting, displaying, or sharing unlawful content.

In a separate post, Chandrasekhar shared that there are legal consequences under existing laws (both criminal n tech laws) for platforms that enable or directly output unlawful content.

“All intermediaries or platforms (are) to ensure that the use of Artificial Intelligence model(s)/LLM/Generative AI, software(s) or algorithm(s) on or through its computer resource does not permit its users to host, display, upload, modify, publish, transmit, store, update or share any unlawful content as outlined in Rule 3(1)(b) of the IT Rules or violate any other provision of the IT Act,” the advisory stated.

Additionally, platforms are instructed to ensure their computer resources do not facilitate bias, discrimination, or threats to the integrity of the electoral process through the use of AI models.

The advisory underscores the importance of informing users about the consequences of engaging with unlawful information on platforms, including potential access restrictions, account suspension, or termination, in accordance with applicable laws.

Moreover, platforms facilitating the creation, generation, or modification of potentially misleading information, such as deepfakes, are urged to embed unique metadata or identifiers for traceability.

Adding to this, Chandrasekhar said that it simply was an advise to “those deploying lab level /undertested AI platforms onto public Internet and that cause harm or enable unlawful content”. The purpose of the advisory is to ask platforms to follow precautions like labelling content and use explicit consent  before deploying content. Additionally, large platforms are also advised to seek permission from the government before deploying any “error prone” models.

Non-compliance with the IT Act and/or IT Rules may result in penal consequences, including prosecution under relevant laws. Platforms are urged to ensure immediate compliance and submit an Action Taken-cum-Status Report to the Ministry within 15 days of the advisory.

Tata Electronics has applied to establish a semiconductor packaging and assembly plant near Guwahati, specifically at Jagiroad, located approximately 55 km away. The proposal is about to be finalised, the minister said.

Union Minister of State for Electronics and Information Technology Rajeev Chandrasekhar on Thursday, February 15, announced that Assam will become home to a semiconductor packaging plan worth 25,000 crore. This facility is expected to create employment opportunities for the youth interested in the semiconductor sector, Chandrasekhar said, speaking at the Digital India #futureSKILLS Summit in Guwahati.

Chandrasekhar said a proposal for the plant, in collaboration with the Tatas Group, is nearing finalisation and will soon be presented to the Union Cabinet for approval.

Chandrasekhar said the plant would provide employment opportunities locally and prevent youths from having to relocate. The minister underscored the emergence of various opportunities in sectors such as Artificial Intelligence, semiconductors, electronics, cybersecurity, and internet technology.

The minister emphasised the importance of studying and developing skills in line with the evolving demands of the job market, noting the participation of globally renowned technology companies like NBDR, Intel, AMD, HCL, Wipro, and IBM in the summit signals ample job opportunities.

Furthermore, he highlighted the role of universities, including IIT Bombay and IIT Guwahati, in equipping the youths of the region with technological skills. Reflecting on India’s economic progress, Chandrasekhar pointed out the transformation from being part of the ‘fragile five’ to becoming a top global economy. The digital economy’s contribution to the GDP has risen from 4% before 2014 to 11%, with projections indicating a further increase to 20% by 2026-27, he said.

India risks losing out to China and Vietnam as it seeks to become a major smartphone export hub and must “act fast” to lure global companies with lower tariffs, the deputy IT minister said in government documents seen by Reuters.

Smartphone manufacturing is a key plank of Prime Minister Narendra Modi’s ambitions to boost the economy and create jobs by attracting companies such as Apple, Foxconn and Samsung to India, the world’s second-largest mobile market, where production grew 16% year-on-year to $44 billion last year.

That success, Modi’s government says, is mostly due to financial incentives given to companies to produce more. But lawmakers and lobby groups for Apple and other firms argue India’s high tariffs are a deterrent for companies de-risking their supply chains beyond China, and nations such as Vietnam, Thailand, and Mexico have raced ahead in phone exports by offering lower tariffs on components.

A January 3 letter and a confidential presentation drafted by Indian Deputy IT Minister Rajeev Chandrasekhar, and sent to the Finance Minister, show the extent of his ministry’s concerns about losing out due to the uncompetitive tariffs.

“India has high production cost due to highest tariffs amongst key manufacturing destinations,” wrote Chandrasekhar in the documents, which were seen by Reuters.

“The geopolitical realignment is forcing supply chains to shift out of China … We must act now, or they will shift to Vietnam, Mexico and Thailand.”

Chandrasekhar and India’s IT ministry did not respond to Reuters requests for comment.

Lower tariffs on components is key to India’s ambitions to attract smartphone manufacturers.

“Made in India” phones use many parts made locally, but companies import many high-end parts from China and elsewhere due to supply chain limitations. These parts are then subject to the high tariffs the government has put in place to protect the local manufacturers, raising overall costs.

U.S. Ambassador Eric Garcetti recently said foreign investments were not flowing into India at the pace they should be, and were going to countries like Vietnam instead, because of the tariffs. “If you tax inputs … you’re not protecting a market. What you are doing is limiting a market,” he said.

Chandrasekhar in his documents flagged how lower taxes in China and Vietnam helped boost their exports. Exports accounted for only 25% of India’s smartphone production last year, compared with 63% of China’s $270 billion worth of production and 95% of Vietnam’s $40 billion worth, he said.

“Match China, beat Vietnam”

India is seeking to account for 25% of global electronics manufacturing by 2029, but the official documents showed its stake was currently at just 4%, even though Apple, Foxconn and Xiaomi had all boosted production recently.

Chandrasekhar’s documents were addressed to India’s Finance Minister Nirmala Sitharaman last month to lobby for lower tariffs in the annual budget. The finance ministry did lower taxes on some components, including battery covers, to 10% from 15%, but did not agree to many other tariff cut requests.

The finance ministry and Sitharaman’s office did not respond to requests for comment.

India still imposes a 20% tax on parts, including chargers, some circuit boards and fully assembled phones. The IT minister wanted those taxes to be reduced to 15% this year.

Chandrasekhar also argued that Vietnam and China do not levy tariffs above 10% on components from their “most-favoured nation” trading partners or nations with whom they have free-trade agreements. India does not do that and imposes “high” tariffs on many components, he said.

“We have to match China and beat Vietnam on tariffs to attract” global supply chains, Chandrasekhar wrote. “No country with high tariffs has or can attract” them.

Local market saturating, exports focus

Last week, Xiaomi privately asked New Delhi to lower tariffs on more components used in cameras and USB cables, saying it will help “aligning with the competitive manufacturing economies like China and Vietnam.”

While surging local demand has helped keep the local manufacturing industry profitable, Chandrasekhar said in his letter that this “domestic market of smartphones will shortly near saturation” and as users don’t change phones that often.

India’s goal to take mobile phone production to over $100 billion a year—with 50% of that exported—needs a new strategy, the minister said.

“Tariffs are becoming a hurdle,” the minister said in his presentation. “We need to shift tariff policy to suit our new ambitions. Exports, not domestic.”

Ashwini Vaishnaw supported tariff cuts

CNBC-TV18 had earlier reported that Telecom, IT and Rail Minister Ashwini Vaishnaw has openly supported the mobile manufacturing industry’s demand for tariff cuts on imported components, calling it the “next logical step”. He confirmed that there was “absolutely” a case made for a cut in import duties on mobile components.

He confirmed his support for the industry demand, in an exclusive conversation with CNBC-TV18, on the sidelines of the 2024 World Economic Forum (WEF) in Davos, Switzerland.

Dixon Technologies’ Managing Director Atul Lall hailed the reduction in import duties on essential components used in making mobile phones in the interim budget.

“This is a big gift the finance ministry has given us before the Budget. We will be passing on these duty cuts to our customers, we are a B2B company. Hopefully, this is going to give a significant flip to the demand side because let’s see how the brands react to it. But undoubtedly, it’s a major positive for us,” he told CNBC-TV18.

Sanjay Kumar Agarwal, Chairman, the Central Board of Indirect Taxes & Customs (CBIC), told CNBC-TV18 in a post-interim budget panel discussion with CNBC-TV18 said, “There was a need felt that on the mobile parts, we must rationalise the rates. Therefore, on certain parts, which are mechanics or diecast parts on which rates have now been lowered from 15% to 10% to rationalise it, and to take care of the disputes which have arisen in past.”

On future tariff revisions, the CBIC Chairman said, “It is an ongoing exercise. Maybe when the full budget will be presented, that time many more such steps may be taken.”

Compliance with the advice on deepfakes has been “mixed” from platforms, according to Chandrasekhar, who added that stronger IT guidelines are likely to be published in the next seven days to address the issue.

The government, he said, had earlier made it clear to social media and online platforms that if its advisory on deepfake is not fully adhered to, new IT rules would follow.

“There has been a mixed performance of compliance and I had said at the time of the advisory, that if we find that the advisory is not being followed through completely, we will follow it up with very clear amended IT rules that will be notified,” Chandrasekhar, Minister of State for IT and Electronics, said on sidelines of an event. The amended IT rules can be expected in the next one week, he said.

“What was in the advisory will be now firmly embedded into the IT rules and we hope to do this in the next week,” he said.

Chandrasekhar, involved in dialogues with intermediaries, highlighted ongoing efforts to convey the seriousness of the deepfake issue. Advisories have been issued, and intermediaries warned about potential consequences for non-compliance with upcoming regulations.

“Existing IT rules provide for combating misinformation, but do not feature specific conditions on terms of use. Amended IT Rules to feature specific requirements for intermediaries, and users on terms of use for,” he added.

After legendary cricketer Sachin Tendulkar flagged his deepfake video doing the rounds, Union Minister Rajeev Chandrasekhar slammed deepfakes as a threat to the safety and trust of Indian users, saying the government will soon notify tighter rules under the IT Act to ensure compliance by platforms.

In a post on X, Tendulkar mentioned the doctored video — where he is seen promoting a gaming application — and expressed concerns about the misuse of technology.

Taking to X, the Minister of State for IT and Electronics thanked Tendulkar for flagging the deepfake video and said “#DeepFakes and misinformation powered by #AI are a threat to Safety&Trust of Indian users and represents harm & legal violation that platforms have to prevent and takedown”.

Chandrasekhar said that a recent advisory by the IT Ministry requires platforms to fully comply with this.

“We will be shortly notifying tighter rules under the IT Act to ensure compliance by platforms,” the minister said.

The fake video shows Tendulkar talking about the merits of the application, saying he did not know that money-making has become so easy and that his daughter uses the platform.

Tendulkar posted the video along with a message in which he expressed concern about the misuse of technology.

“These videos are fake. It is disturbing to see rampant misuse of technology. Request everyone to report videos, ads & apps like these in large numbers,” Tendulkar wrote in the post on X.

Tendulkar had exhorted social media platforms to be alert and responsive to complaints.

“Swift action from their end is crucial to stopping the spread of misinformation and deepfakes,” he wrote.

Deepfakes refer to synthetic or doctored media that is digitally manipulated and altered to convincingly misrepresent or impersonate someone using a form of artificial intelligence (AI).

Last month, the government had directed all platforms to comply with the IT rules and mandated companies to inform users in clear and precise terms about prohibited content.

The government talked tough with social media platforms after several ‘deepfake’ videos targeting leading actors, including Rashmika Mandanna, sparked public outrage and raised concerns over the weaponisation of technology for creating doctored content and harmful narratives.

The Centre has asked platforms to act decisively on deepfakes and align their terms of use and community guidelines as per the IT Rules and current laws. The government has made it clear that any compliance failure would be dealt with strictly and evoke legal consequences.

Taiwanese electronics manufacturing services company Foxconn has submitted an application for setting up a semiconductor fab in the country, Parliament was informed on Wednesday.

Minister of State for Electronics and IT Rajeev Chandrasekhar said in a written reply to Lok Sabha that the government has taken several measures to boost electronics manufacturing, including semiconductors, incentivising large investments in electronic goods and appliances, and promote exports.

“Foxconn has submitted its application under the “modified scheme for setting up of semiconductor fabs in India” for the establishment of semiconductor fab in the country,” Chandrasekhar said. The development comes after Foxconn exited a joint venture (JV) with Vedanta Group to set up a chip plant in India.

The JV had plans to set up its chip plant in Gujarat with an investment of around Rs 1.5 lakh crore. Chandrasekhar said the first semiconductor unit by Micron was approved in June 2023 under the Semicon India programme and the construction of the unit has started.
