Ghosts of round-tripping gone with new foreign investment regulations, say experts

New rules on foreign investments is a game-changer, with many relaxations, simplifications and the clarity given on how India can capture the global growth opportunities.

The key highlights are the clearer round-tripping guidelines, lift to Alternative Investment Fund (AIF) investments in assets with no connection to India, portfolio investment opportunities even in unlisted entities overseas and a big thrust given to the financial services investment opportunities by even non-financial services companies in India. Rules also open investment opportunities to be captured in IFSC by both, companies as well as individuals.

The Thought League: Experts discuss ethical capital and sustainability in post-pandemic world

In this episode of Season 2 of: ‘CNBC-TV18 & Cyril Amarchand Mangaldas Present The Thought League’, experts discussed the strength of ethical capital.

To deep dive into this thought leadership discussion, CNBC-TV18’s Nisha Poddar spoke to Dr Simon Longstaff, Executive Director, The Ethics Centre & Cyril Shroff, Managing Partner, Cyril Amarchand Mangaldas.

Longstaff said, “One of the things that investors in particular are interested in, and also other stakeholders – is the degree to which you can actually predict the conduct of a corporation. And to do that you need to know the degree to which there is alignment between what it says and stands for, and also the extent to which it accords with the expectations of society. You take those two things together and the level of alignment amounts to ethical capital. The basis on which you can make judgments about the reliability of what a company says and what it will actually do and it has a huge impact in on risk adjusted returns.”

Shroff said, “I think this conversation about ethical capital is way larger than just sustainability. I think it is a far more deep-rooted philosophy on the basis of which private enterprise or any sort of enterprise could be founded. An ethical capital in my belief is as old as capital itself.”

He added, “In today’s times, which are so volatile, there is so much money floating around, there are huge temptations because of greed, this concept is more important than ever before. So, I completely resonate with Simon’s observations that we need to look at the market and look at enterprises and businesses through the lens of their performance on ethical capital and it is hard to find an index that kind of measures it, but you will know it when you see it.”

The Thought League: India needs to become a rule maker rather than a taker, says Cyril Shroff

In Season 2 of the Thought League, the focus is on global geopolitics in this new changed world. The power struggle of the future will be on new grounds in a changed environment and the digital revolution will play a big role in it. CNBC-TV18’s Nisha Poddar caught up with Jan Janmejaya Sinha, Chairman-India of Boston Consulting Group and Cyril Shroff of Cyril Amarchand Mangaldas.

Sinha said, “Privacy in an authoritarian regime is different from privacy in a liberal democracy. So issues around data localization, around monopolies about taxation, around immigration, around cyber, around sanctions will all be areas that will lead maybe to conflict and the creation of different blocks in the technology sphere. So within this is what we will see the emergence of the new geopolitics and in this there will be areas which countries like India will in some places be cooperating and other places will be competing and in some places, being very, very careful about the areas and issues that we will face conflict on.”

On what is India’s role in these global institutions in its own benefit Shroff said, “Just to sort of build on the current theme, a lot of the future rivalry will be fought in terms of influence. One of the favorite playgrounds for that will be international institutions, whether it is IMF, World Bank, WTO, WHO and the G20 and India is going to be taking over the presidency of G20 in the near future. So there is a huge opportunity. But what China has done over the years, it has got very senior people in many of these global institutions and India needs to do likewise. It needs to get to a position where we become a rule maker rather than just a rule-taker.”

As India gets ready for a global direct listing, CNBC-TV18’s Nisha Poddar speaks to New York Stock Exchange’s Alex Ibrahim on the traction seen in emerging countries like India to tap into the US markets.

According to Alex, the pipeline for foreign listings is strong for 2021.

“Lots of liquidity in the public markets in the US is a greater opportunity for the companies to raise capital, but also companies come to the US markets because they want to diversify their shareholder base. They want to have access to small retail investors, they want to have access to large institutional investors and also increase the visibility,” he said.

On themes and sectors, Ibrahim said, “The companies coming to the US capital markets, the sectors that we are seeing, I would say larger representation is the technology and tech-related companies. We have seen quite a few companies this year in e-commerce, techEd, educational tech, so these are sub-sectors of technology that are actually companies coming to the US capital markets and raising capital and receiving very strong support by the US and global investors.”

“When we look at 2021, we believe there will be a continuation of those sectors but I would also add healthcare. We see orders especially from emerging markets tapping US capital markets to raise capital,” he added.
