Congress seeks ‘Karnataka model’ in Manipur, Goa and Meghalaya

After Karnataka Governor Vajubhai Vala’s controversial decision to invite the single largest party and not the largest post-poll group,  the opposition Congress is up in arms

After BS Yeddyurappa was sworn in as the chief minister of Karnataka on Thursday for the third time, Congress and Rashtriya Janata Dal (RJD) have claimed stake to form governments.

Yeddyurappa took oath Thursday morning even as opposition leaders protested outside the Bengaluru assembly. Sworn enemies Siddharamaiah and Kumaraswamy rubbed shoulders as they sat next to each other shouting slogans, all this after the Supreme Court opened its gates at 1:45 am to hear a petition challenging the Karnataka governor’s decision.

The court ruled at 5:30 am that it will not stop Yeddyurappa’s swearing-in but has scheduled the next hearing in the case on Friday.

With Yeddyurappa formed the government as the leader of the single-largest party, Congress MLAs in Goa are seeing an opening. Congress leader Yatish Naik has said that they are the single largest party in the state and has appealed to the governor to invite them to form the government in the state.

The party also said that it is willing to face a floor test.

Former Manipur chief minister and Congress leader Okram Ibobi Singh said that party will be staking claim before Manipur’s governor on Friday.

Similarly in Bihar, RJD leader, Tejashwi Yadav, said that he will be meeting the governor of Bihar Satya Pal Malik at 1:00 pm tomorrow and offered to parade the MLAs of his party.

Meanwhile, Meghalaya Congress is also staking claim to forming the government by stating that they are the single largest party in the state.

 

 

In Manipur, the former congress chief minister Ibobi Singh met the governor and staked his claim to form the government as he is the leader of the single-largest party in the state.

Sudesh Varma, spokesperson of BJP, Adil Singh Boparai, spokesperson of Congress, Sanjay Hegde, a senior Supreme Court lawyer, Chandan Gowda, a professor of sociology at the Azim Premji University in Bengaluru, DP Satish, senior editor at Network18, and Majeed Memon, Rajya Sabha MP of the NCP discussed the dramatic turnarounds taking place around Karnataka elections.

Karnataka Governor Vajubhai Vala’s controversial decision to invite the single largest party and not the largest post-poll group, has opened a plethora of requests from opposition parties in different states of Goa, Manipur, Meghalaya and Bihar.

After BS Yeddyurappa was sworn in as the chief minister of Karnataka on Thursday for the third time, Congress and Rashtriya Janata Dal (RJD) have claimed stake to form governments.

In Goa, Yatish Naik has said that Congress is the single largest party in the state and has appealed to the governor to invite them to form the government in the state.

The party also said that it is willing to face a floor test.

In last year’s Goa assembly elections, Congress had won 17 seats and the BJP had got 13 seats. But at last minute, BJP managed to form the government with the support of small time allies.

Former Manipur chief minister and Congress leader Okram Ibobi Singh said that party will be staking claim before Manipur’s governor tomorrow.

In Manipur, Congress emerged as the single largest party with 28 seats but it was the BJP that successfully formed the government despite winning 21 seats.

Similarly in Bihar, RJD leader, Tejashwi Yadav, said that he will be meeting the governor of Bihar Satya Pal Malik at 1:00 pm tomorrow and offered to parade the MLAs of his party.

RJD won 68 out of 243 seats in the Assembly polls held in 2015 but BJP-Nitish Kumar alliance formed the government.

Meanwhile, Meghalaya Congress is also staking claim to forming the government by stating that they are the single largest party in the state.

In 60-member Meghalaya Assembly, Congress won the maximum seats, but BJP was invited to form the government.

Summary

Recent developments in Karnataka have thrown open the possibilities of a grand alliance against the BJP-led NDA ahead of general elections next year.

It has been a race against time insofar as the post-election developments in Karnataka is concerned.

As it appears, a few hours after BS Yedyurappa having been sworn in as chief minister of the state, the BJP seems banking only on the party being in power at the Centre and, thus wielding the clout of the office of the governor against the Congress’ rapid speed action.

A role reversal, so to say; the Congress seems to have given up the luxury of sleeping when others are at work and, thus make sure that Goa and Manipur were lessons to learn in not letting a slip between the cup and the lip.

Well, it could be that controlling the reins of the state administration in Karnataka is so important for both the Congress and the BJP. It, probably, is that fighting the general elections, due in 2019 (or even earlier as some say) is going to cost a lot of money and Karnataka is where it could come from.

The Kolar Gold Fields have gone dry, but money may come from other mines too. Even though the Supreme Court declared one of the mining barons of Bellary out-of-bounds from the region, he was held in high esteem by the BJP. Hence, Karnataka is important and not just the 21st state to capture, it seems.

The developments in the couple of days after May 15 are significant for a few reasons other than the sheer drama and the absurdities around. They have thrown open the possibilities of a grand alliance against the BJP-led NDA ahead of general elections, and apart from this raised a few questions on whether the constitutional scheme of things are going on a path similar to where it was led to on the night of June 25, 1975.

Let me answer the first possibility.

Attempts to make an alliance or loose arrangements had begun even before Karnataka went to polls. Mamata Banerjee meeting the TRS leader, flying over to Mumbai and then reaching out to Sonia Gandhi were one such moves.

The CPI(M), amending its political resolution to favour understandings and arrangements with the Congress was another, and the most significant of all being the SP-BSP understanding to not engage in internecine fights and instead work to defeat the BJP in Gorakhpur and Phulpur and persisting with that in Khairana too.

The results of the Karnataka elections and the speed at which the Congress and the Janata Dal (S) decided to get together clearly show that all those who are not with the BJP are now willing to get together, because all seem to have realised that their own survival is at stake.

There are reports, and even taking them with a pinch of salt, that Mayawati did influence former prime minister, HD Deve Gowda to engage with the Congress, and it is a fact that such an engagement took place within a few minutes in all and a post-poll alliance sealed. The leaders of the two parties walked into the Raj Bhawan in Bengaluru to stake claims long before sunset the same day the results came in.

A Throw Back to 1996

Contrast this with the summer of 1996 in New Delhi, 22 years ago, witnessed a post-poll coalition taking shape and involving some who are also around now. But the pace of events were too slow and boring to journalists. Those were, fortunately, days when TV had not become 24 X 7 and social media was not even heard of.

Leaders of the non-BJP opposition consumed at least a couple of weeks, and met at one guest house or another of the various state governments they controlled then — Andhra Pradesh and Bihar Bhawans (The two states were yet to be bifurcated then) Karnataka House where the then state chief minister HD Deve Gowda had set up his base and the Tamil Nadu House (where the chief minister elect, M Karunanidhi had moved into) — hosted meetings where the leaders could not identify who their prime minister elect was.

One day they suggested Jyoti Basu, the then chief minister of West Bengal, become prime minister. His party, the CPI(M), told that it cannot happen. Then they spent another couple of days simply talking among themselves and one afternoon, as if a bolt from the blue, someone shouted Deve Gowda is the PM elect.

Gowda then waited for a letter of support from the then Congress president (and prime minister under whom the Congress lost heavily in 1996) that did not come. On May 15, 1996, then president, SD Sharma, invited Atal Bihari Vajpayee to be sworn in the day after. Gowda, the Congress and everyone around protested, but Vajpayee was sworn in.

MPs from Uttar Pradesh and some other states were held at the Andhra Pradesh Bhawan with Chief Minister Chandrababu Naidu assuring that poachers will be dealt with.

Mulayam Singh Yadav’s MPs ended up relishing cuisine from the south of India and the United Front remained intact to elect the Congress party’s PA Sangma as the Lok Sabha speaker. Sangma was unanimously elected Speaker of the Lok Sabha on May 23, 1996.

It was evident, that day, that Vajpayee was not going to survive the confidence vote, scheduled for May 29. Vajpayee did not press for a vote and told the House, through the speaker, that he was going to the Rashtrapathi Bhawan to submit his resignation. He resigned after a long debate and Gowda was  sworn in as prime minister in just a couple of days.

Well. It now appears that we have come a long way. Karnataka Governor, Vajubhai Vala was not having to grope in the dark as did the then president, SD Sharma. He was informed, as early as before sunset on May 15, 2018 that HD Kumarasamy commanded support of 116 MLAs and a little later by Yedyurappa that he had 104 MLAs with him — this was even before the Election Commission declared the results formally.

Even while the governor waited, the media got busy reporting cases of MLAs gone ‘missing’. The BJP leaders who had announced their capture of Karnataka (thankfully not in the same way as erstwhile kings did in the past by setting fire to the captured kingdoms or in the way the BJP did in Tripura by pulling down statues) ended up calling the Congress-JD(S) agreement amoral.

The Congress, meanwhile, seem to have decided against taking any chances. Abhishek Manu Singhvi had the draft Writ Petition ready during the day on May 16 and the governor’s late night invite to Yeddyurappa to be sworn in, violating the law as laid down by the Supreme Court in the Rameshwar Prasad case of 2006, shows that the Congress leadership knew what was cooking in the Raj Bhawan in Bengaluru.

The party, once again, acted with such speed and contrast this with May 1996. A mid-night knock at the portals of justice and the swearing in allowed with conditions. For the first time in our short history indeed.

What lies next can be partly a presumption and partly conditioned by political convictions.

  1. It is likely that the Supreme Court, when it hears the writ petition on May 18 declares the Governor’s action inviting Yeddyurappa illegal and, thus makes the swearing in null and void.
  2. It is also likely that the Supreme Court lets a few days of filibuster and the chief minister ‘manages’ the numbers.
  3. The apex court may also order a floor test earlier than the fortnights time the governor has sanctioned and also have it monitored by its officers.

In the event of any of these, the assembly will be called to meet, the House will have to elect the speaker (the first business after the members are sworn in) and the Congress-JD(S) coalition fields its own candidate for the chair and either he/she is elected unanimously (as it happened in 1996 in the Lok Sabha with Sangma) or he/she defeats the BJP candidate in that.

This will ensure that the Congress-JD(S) MLAs are not poached by the BJP because the Assembly speaker will then be able to ‘deal’ with such renegades in accordance with the Tenth Schedule of the Constitution.

Well, in case the BJP manages to get its own speaker elected, which is possible only if Congress-JD(S) MLAs defect by then, the game is up insofar as Karnataka is concerned.

The field, however, is open even then for a realignment before May 2019. All that will be matter is whoever commands the resources from the state where the Kolar Gold Fields used to have gold reserves until some years ago. The gold reserves may have depleted. But mother earth, in Karnataka, has a lot more to give to those who are in game to exploit.

In any case, as of now, on May 18, 2018, we are closer to where India was taken to a couple of hours before midnight on June 25/26, 1975.

Slamming Governor Vajubhai Vala’s invite to B S Yeddyurappa to form the government, JDS leader H D Kumaraswamy accused the Narendra Modi government of misusing Constitutional institutions.

“We will not let it go easily…”, a furious Kumaraswamy told reporters shortly after the governor wrote to Yeddyurappa asking him to take oath as chief minister tomorrow and to prove majority in the assembly in 15 days.

Kumaraswamy said the governor should have given three or four days time for Yeddyurappa to prove his majority.

“He (Yeddyurappa) has no majority,” Kumaraswamy said.

The JDS leader, who has also staked claim to form the government with the support of Congress, alleged that various allurements were being offerd to the MLAs to switch sides.

“It will be a repeat of 2008…they will loot the state,” he said, referring to the then BJP rule and citing the mining baron Reddy brothers.

Asked about the next step, he said, “wait and see.”

BJP General Secretary Muralidhar Rao has said Yeddyurappa will take oath tomorrow at 9 AM.

After Karnataka Governor Vajubhai Vala on Wednesday invited BJP legislative party leader BS Yeddyurappa to form the new government in the state, the Congress approached Supreme Court Chief Justice Dipak Misra for an urgent hearing on the matter.

The Congress urged Misra to hold an urgent hearing Wednesday night itself since Yeddyurappa is slated to take oath as chief minister at 9 am tomorrow.

Congress leader Abhishek Singhvi is the leading his party’s challenge.

“We have filed a petition before the Supreme Court and have urged the registrar to allow hearing on it tonight itself,” Singhvi told PTI, adding that immediate hearing has been sought as the matter is very serious.

The Congress termed the governor’s decision as “murder of democracy and trampling of Constitution”.

“We hope Governor will take the correct decision according to Constitution. If Congress-JD(S) combine is not called, it will be illegal. We hope politics will not trump legality and morality. If it does, we have no option but to move court,” Singhvi  told CNN News18.

The Congress said the Governor denigrated his office, trampled the Constitution and acted as a BJP puppet.

The Congress on Wednesday lambasted Karnataka Governor Vajubhai Vala for inviting BJP leader B S Yeddyurappa to form the government in the state, accusing him of acting like a “BJP puppet” and allowing the saffron party to “manufacture” a majority in 15 days.

Congress leader P Chidambaram also alleged that the Governor has given Yeddyurappa 15 days time to “convert” the number of 104 legislators to 111.

“Governor invites Mr Yeddyurappa to manufacture a majority in 15 days.

“Governor gives Mr Yeddyurappa 15 days to convert the number 104 into 111,” he tweeted.

Party general secretary Ashok Gehlot said that the decision was a “murder of democracy” and has been taken “under pressure from the BJP leadership”.

“It is a murder of democracy in the country and it is a black day in India’s history…The decision has been taken under pressure of BJP leaders,” Gehlot told PTI.

Gehlot expressed concerns over the development and said people of the country are “worried” over the direction in which the country was moving.

In a communique, Vala invited Yeddyurappa to form the government and take oath as chief minister tomorrow. He also asked Yeddyurappa to seek a vote of confidence within 15 days of assuming office.

The BJP has emerged as the single largest party in the southern state winning 104 seats, but is short of a simple majority. On the other hand, the Congress and JD(S), which have already announced post-poll tie-up, have won 78 and 37 seats respectively and claimed before Vala to have numbers to form government in the state.

Congress’ chief spokesperson Randeep Singh Surjewala also hit out at Vala, accusing him of denigrating the Governor’s office, trampling upon Constitution and abusing law and acting like a “BJP puppet”.

Vala, Surjewala charged, chose to serve “his masters in the BJP” than serving the Constitution.

“Vajubhai Vala denigrates the Governor’s office,tramples upon Constitution,abuses the law & acts as a BJP puppet.

“He chooses to serve his Master’s in BJP rather then serve the Constitution.

As @BJPKarnataka informed in advance, orders come from BJP HQ then the sanctity of office,” he said on Twitter.

Karnataka Governor Vajubhai Vala on Wednesday invited BJP legislature party leader B S Yeddyurappa to form the government in Karnataka, capping a day of intense jockeying for power and allegations by the Congress of bribery and horse-trading against the BJP and Prime Minister Narendra Modi.

“I invite you (Yeddyurappa) to form the government and be sworn-in as the Chief Minister of Karnataka,” a Raj Bhavan communique said.

Vala also asked 75-year-old Yeddyurappa to seek a vote of confidence within 15 days of assuming office as the chief minister.

Briefing reporters, BJP General Secretary Muralidhar Rao said Yeddyurappa will take oath tomorrow at 9:00 am.

The governor took the decision after consulting with former Attorney General Mukul Rohtagi, who favoured inviting the single largest party first.

Prime Minister Modi and BJP chief Amit Shah are unlikely to attend the swearing in ceremony, party sources said.

Toiling hard to control the levers of power in Karnataka, Yeddyurappa and H D Kumaraswamy, the leader of the newly formed JD(S)-Congress alliance had earlier met Vala and staked claim to form the government.

With 104 MLAs in the 224-member Assembly, the BJP is the single largest party, while the JD(S)-Congress coalition, formed after the election results were declared, has 116 legislators. It has also claimed support of an independent MLA.

With there being precedents of both governors inviting either the leader of the single largest party or that of a post-poll coalition to form the government, Vala, a former RSS-BJP veteran from Gujarat, opted for the former.

The JDS and Congress had met the governor at the Raj Bhavan when Vala had assured that he will consult legal experts and consider the precedents of Goa and Manipur.

The JDS-Congress combine has 117 MLAs, well clear of the half-way mark.  Earlier, the Congress said that it would move the Supreme Court if denied the chance to form the government first.

Meanwhile, DG intelligence has asked all superintendents and commissioners of police across Karnataka to be alert as the Congress and JD(S) may start protests against governors decision to invite the BJP to form the government.

Yeddyurappa, on Wednesday, met the governor and said that he had requested the him to allow the BJP to form government in the state at the earliest.

Allegation of bribery charge, horse-trading, phone tapping, MLAs huddled together in buses ready to be taken to resorts near Bengaluru, frenzied jockeying for power in Karnataka a day after the state’s voters delivered a fractured mandate.

BJP’s BS Yeddyurappa hit the ground running on Wednesday morning as he met the governor to stake his claim to form the government.

Later in the day, HD Kumaraswamy of the JD(S) also met the governor to stake his claim to form the government.

The BJP has 104 MLAs, which is 8 short of the majority, while the Congress and the JD(S) claimed to have the support of 117 MLAs which will give them a clear majority.

Meanwhile, Kumaraswamy dropped a bombshell by saying that the BJP got in touch with him and offered Rs 100 crore for each of their 37 MLAs.

The BJP refuted the allegation and said it is “baseless” and “imaginary”.

Kumaraswamy also warned the BJP against horse-trading.

“We have the power to poach twice the number of BJP MLAs,” he said.

As the politicians engage in mudslinging, there are also reports that all parties are scrambling to keep their flock together.

Of the 221 newly-elected Karnataka MLAs, 77 MLAs have declared criminal cases against them, while 215 are crorepatis, says a report released by the Association for Democratic Reforms (ADR).

“Out of the 221 MLAs analysed, 77 (35%) MLAs have declared criminal cases against themselves. Out of 218 MLAs analysed during Karnataka Assembly elections in 2013, 74 (34%) MLAs had declared criminal cases against themselves,” the report by ADR said.

The ADR have analysed the affidavits of 221 newly-elected MLAs in the 2018 Karnataka assembly elections.

Among MLAs with serious criminal cases, 54 (24%) MLAs have declared serious criminal cases including cases related to attempt to murder, kidnapping etc.

Out of 218 MLAs analysed during Karnataka Assembly elections in 2013, 39 (17%) MLAs had declared serious criminal cases against themselves.

Among party wise MLAs with criminal cases, 42 (41%) out of 103 MLAs from BJP, 23 (30%) out of 78 MLAs from Congress and 11 (30%) out of 37 MLAs from JD(S) MLAs have declared criminal cases against themselves in their affidavits.

Besides, 29(28%) out of 103 MLAs from BJP, 17 (22%) out of 78 MLAs from Congress and 8 (22%) out of 37 MLAs from JD(S) MLAs have declared serious criminal cases against themselves in their affidavits.

“Out of the 221 newly elected MLAs, 215 (97%) are crorepatis. Out of 218 MLAs analysed during Karnataka 2013 assembly elections, 203 (93%) MLAs were crorepatis,” the report said.

Among partywise crorepati MLAs, 101 MLAs from BJP, 77 from Congress, 35 from JD(S), one from Karnataka Pragnyavantha Janatha Party and one independent have declared assets valued more than Rs 1 crore.

The average assets per MLA for 103 MLAs analysed is Rs 17 crore, 78 Congress MLAs (Rs 60 crore), 37 JD(S) MLAs (23 crore), one Karnataka Pragnyavantha Janatha Party MLA (265 crore) and one BSP MLA (75 lakh).

The top three MLAs with high assets are N Nagaraju of Congress with total assets of over Rs 1,015 crore, followed by DK Shivakumar from Congress (Rs 840 crore) and Suresh BS from Congress (Rs 416 crore).

Three MLAs in Karnataka with lowest assets are SA Ramadas from BJP (Rs 39 lakh), A S Ravindra from JD(S) (Rs 68 lakh) and N Mahesh from BSP (Rs 75 lakh).

The report said that 27 out of 221 MLAs have not declared their sources of income.

On their education details, the report said that 80 MLAs have declared their qualification to be between 5th pass and 12th pass, while 133 have declared having a qualification of graduate or above.

If they had won these seats, that included Badami where outgoing CM Siddaramaiah narrowly won with a margin of 1696 votes, they could have ended up crossing the majority mark by winning 115 seats.

As BJP struggles to form a government in Karnataka after becoming the single largest party, the narrow gap with which it lost eleven seats, reveal how close it was from gaining a majority.

As per the Election Commission of India website, the saffron party has lost 11 seats in the assembly elections for a margin that was below 3,000.

If they had won 11 seats, that included Badami, where outgoing Chief Minister Siddaramaiah narrowly won with a margin of 1,696 votes, they could have ended up crossing the majority mark by winning 115 seats.

The other ten seats which saw a similar outcome were Maski, Hirekerur, Kundgol, Yellapur, Gadag, Sringeri, Athani, Vijay Nagar,Jamkhandi and Yemkanmardi.

However, it was not just BJP who had to suffer narrow defeats.

Rival Congress lost two seats, Aland to BJP and Krishnarajanagara to JD(S), for less than 3,000 votes.

JD(S) also saw its candidates defeated at Pavagada by Congress and in Turuvekere by BJP to similar margins.

But it is BJP, now finding itself facing the alliance between Congress and JD(S) that will be most hurt by the narrow defeats.
