The Congress on Sunday alleged that prices of petroleum products were being used by Prime Minister Narendra Modi “as a tool” to benefit BJP during elections and demanded that the prices should stay at least at the level that prevailed during the Karnataka assembly elections.

Talking to reporters here, Congress spokesperson Jaiveer Shergill said the price of petrol and diesel were at a record five-year high, and if the government can control price of petroleum products during Karnataka polls, it should do so around the year in the interest of people.

“If he (Modi) can control the price (of petrol and diesel) for his own interest during the polls in Karnataka, why can’t he do it now and all year around in public interest? That means fuel prices is just a tool for him to get the benefit in elections.

“On behalf of the people of India, that at least control the price if you cannot reduce it. Modi should give priority to the interest of public over his political interests,” he said.

State-run Indian Oil Corp on Sunday raised transport fuel to record highs in Delhi on the seventh day of resuming the daily price change system, following a temporary suspension that lasted 20 days.

The price of petrol in Delhi touched a record high of Rs 76.24 per litre under the dynamic pricing regime beating the previous high of Rs 76.06 in the city on September 14, 2013.

Congress-Janata Dal (Secular)’s joint Chief Ministerial candidate H.D. Kumaraswamy will take the oath for the office on May 21 between 12 noon to 1 pm, ANI reported on Saturday.

Kumaraswamy said that he was invited by Vajubhai Vala, Karnataka’s Governor, to form a government led by both Congress and JD (S) and to prove a majority in 15 days in the State Assembly.

However, Kumaraswamy remained positive and said that the said given days is not required to prove the majority.

The parties will invite Rahul Gandhi for the swearing-in ceremony.

Power has never influenced my determination to stand up for a cause, Kumaraswamy said adding that he wants to congratulate the judiciary for saving the democracy.

A petition was filed in the Supreme Court by the Congress-JD (S) against the Karnataka Governor’s decision to invite B.S. Yeddyurappa to form government.

Earlier, B. S. Yeddyurappa resigned as the Chief Minister of Karnataka in the State Assembly before the floor test, in which the party was supposed to gain a majority, to stake its claim to form the largest single-party government.

Following the resignation of Yeddyurappa, many state regional party leaders as well as Congress leaders congratulated and welcomed the decision.

 

The Congress won 78 seats and the Janata Dal-Secular (JD-S) won 37 wherein the Congress later said it would support a JD-S led government after the May 12 elections threw up a hung assembly.

Bharatiya Janata Party had won 104 seats in the Assembly elections held in 222 segments, falling short of eight seats of the 112 halfway mark.

B. S. Yeddyurappa resigned as the Chief Minister of Karnataka in the State Assembly before the floor test, in which the party was supposed to gain a majority to stake its claim to form the largest single-party government on Saturday.

Earlier, before the floor test in the Assembly, an emotional Yeddyurappa said that the people of Karnataka had given BJP the mandate to form the government and condemn the “backdoor” politics by Congress- JD(S).

He added that he will stand by the farmers and dalits till his last breath and work for crop loan waiver of up to 1 lakh in public sector bank, co-operative bank and 1.5 lakh crore towards irrigation and other welfare schemes.

The Supreme Court on Friday had ordered a floor test in the Karnataka Assembly at 4 p.m. on Saturday.

K.G. Bopaiah, continued as the pro-tem speaker during the proceedings and was present for the floor test which was broadcast live as per the Supreme Court’s orders.

Yeddyurappa held final round of talks earlier today with senior BJP officials, Prakash Javadekar and Murlidhar Rao.

Yeddyurappa, 75, took the oath in Kannada in the presence of party’s central and state leaders and its newly-elected legislators and senior officials.

The newly appointed Members of the Legislative Assembly (MLAs) took their oath after the Karnataka Assembly session began on Saturday.

Bharatiya Janata Party had won 104 seats in the Assembly elections held in 222 segments, falling short of eight seats of the 112 halfway mark. BJP leader B.S. Yeddyurappa was on Thursday sworn in as the Chief Minister.

The Supreme Court will hear on Saturday morning an application by the Congress and the JD-S challenging Karnataka Governor Vajubhai Vala’s decision to appoint KG Bopaiah, a relatively junior MLA, as the pro-tem Speaker.

Advocate Dev Dutt Kamat, who has filed the application, told reporters at the Supreme Court that the application was filed at 7:45 pm and has been listed to be heard by a bench of Justice AK Sikri, Justice SA Bobde and Justice Ashok Bhushan at 10:30 am on Saturday.

He said the Supreme Court has passed scriptures against Bopaiah for acting in a partisan manner and disqualifying MLAs who had earlier revolted against then Chief Ministere BS Yeddyurappa.

Bopaiah is to preside over the floor test on Saturday to ascertain whether newly-appointed Chief Minister Yeddyurappa enjoys a majority support in the assembly.

In the evening, a team of Congress leaders arrived at the Supreme Court to file the plea.

The Congress has contended that Bopaiah is not the senior-most member in the newly-elected House and as per the parliamentary convention, it is only the senior-most member in terms of number of times he has been elected to the Assembly who can be a pro-tem Speaker.

Earlier in the day, the party alleged Bopaiah’s appointment was made “with the sole intent of manufacturing a majority out of minority for Yeddyurappa”.

Congress approaches Supreme Court against appointment of KG Bopiah

In an another controversial move, the Karnataka governor Vajubhai Vala  has appointed three time MLA KG Bopiah as the pro-tem speaker, breaking convention of inviting the senior most MLA.

Congress has submitted a plea requesting urgent hearing in the Supreme Court against the appointment of KG Bopaiah. The Supreme Court has not yet listed the matter for hearing, reported CNN-News18. 

Earlier, the Supreme Court ordered a floor test in the Karnataka Assembly at 4 PM on Saturday, drastically slashing the 15-day window given by the governor to BJP Chief Minister B S Yeddyurappa to prove majority.

The apex court turned down the plea of BS Yeddyurappa’s counsel Mukul Rohatgi who had sought time till at least Monday to conduct a floor test.

The court observed that there were enough precedents to conduct a floor test within a day’s time.

Congress seeks ‘Karnataka model’ in Manipur, Goa and Meghalaya

After Karnataka Governor Vajubhai Vala’s controversial decision to invite the single largest party and not the largest post-poll group,  the opposition Congress is up in arms

After BS Yeddyurappa was sworn in as the chief minister of Karnataka on Thursday for the third time, Congress and Rashtriya Janata Dal (RJD) have claimed stake to form governments.

Yeddyurappa took oath Thursday morning even as opposition leaders protested outside the Bengaluru assembly. Sworn enemies Siddharamaiah and Kumaraswamy rubbed shoulders as they sat next to each other shouting slogans, all this after the Supreme Court opened its gates at 1:45 am to hear a petition challenging the Karnataka governor’s decision.

The court ruled at 5:30 am that it will not stop Yeddyurappa’s swearing-in but has scheduled the next hearing in the case on Friday.

With Yeddyurappa formed the government as the leader of the single-largest party, Congress MLAs in Goa are seeing an opening. Congress leader Yatish Naik has said that they are the single largest party in the state and has appealed to the governor to invite them to form the government in the state.

The party also said that it is willing to face a floor test.

Former Manipur chief minister and Congress leader Okram Ibobi Singh said that party will be staking claim before Manipur’s governor on Friday.

Similarly in Bihar, RJD leader, Tejashwi Yadav, said that he will be meeting the governor of Bihar Satya Pal Malik at 1:00 pm tomorrow and offered to parade the MLAs of his party.

Meanwhile, Meghalaya Congress is also staking claim to forming the government by stating that they are the single largest party in the state.

 

 

In Manipur, the former congress chief minister Ibobi Singh met the governor and staked his claim to form the government as he is the leader of the single-largest party in the state.

Summary

Recent developments in Karnataka have thrown open the possibilities of a grand alliance against the BJP-led NDA ahead of general elections next year.

It has been a race against time insofar as the post-election developments in Karnataka is concerned.

As it appears, a few hours after BS Yedyurappa having been sworn in as chief minister of the state, the BJP seems banking only on the party being in power at the Centre and, thus wielding the clout of the office of the governor against the Congress’ rapid speed action.

A role reversal, so to say; the Congress seems to have given up the luxury of sleeping when others are at work and, thus make sure that Goa and Manipur were lessons to learn in not letting a slip between the cup and the lip.

Well, it could be that controlling the reins of the state administration in Karnataka is so important for both the Congress and the BJP. It, probably, is that fighting the general elections, due in 2019 (or even earlier as some say) is going to cost a lot of money and Karnataka is where it could come from.

The Kolar Gold Fields have gone dry, but money may come from other mines too. Even though the Supreme Court declared one of the mining barons of Bellary out-of-bounds from the region, he was held in high esteem by the BJP. Hence, Karnataka is important and not just the 21st state to capture, it seems.

The developments in the couple of days after May 15 are significant for a few reasons other than the sheer drama and the absurdities around. They have thrown open the possibilities of a grand alliance against the BJP-led NDA ahead of general elections, and apart from this raised a few questions on whether the constitutional scheme of things are going on a path similar to where it was led to on the night of June 25, 1975.

Let me answer the first possibility.

Attempts to make an alliance or loose arrangements had begun even before Karnataka went to polls. Mamata Banerjee meeting the TRS leader, flying over to Mumbai and then reaching out to Sonia Gandhi were one such moves.

The CPI(M), amending its political resolution to favour understandings and arrangements with the Congress was another, and the most significant of all being the SP-BSP understanding to not engage in internecine fights and instead work to defeat the BJP in Gorakhpur and Phulpur and persisting with that in Khairana too.

The results of the Karnataka elections and the speed at which the Congress and the Janata Dal (S) decided to get together clearly show that all those who are not with the BJP are now willing to get together, because all seem to have realised that their own survival is at stake.

There are reports, and even taking them with a pinch of salt, that Mayawati did influence former prime minister, HD Deve Gowda to engage with the Congress, and it is a fact that such an engagement took place within a few minutes in all and a post-poll alliance sealed. The leaders of the two parties walked into the Raj Bhawan in Bengaluru to stake claims long before sunset the same day the results came in.

A Throw Back to 1996

Contrast this with the summer of 1996 in New Delhi, 22 years ago, witnessed a post-poll coalition taking shape and involving some who are also around now. But the pace of events were too slow and boring to journalists. Those were, fortunately, days when TV had not become 24 X 7 and social media was not even heard of.

Leaders of the non-BJP opposition consumed at least a couple of weeks, and met at one guest house or another of the various state governments they controlled then — Andhra Pradesh and Bihar Bhawans (The two states were yet to be bifurcated then) Karnataka House where the then state chief minister HD Deve Gowda had set up his base and the Tamil Nadu House (where the chief minister elect, M Karunanidhi had moved into) — hosted meetings where the leaders could not identify who their prime minister elect was.

One day they suggested Jyoti Basu, the then chief minister of West Bengal, become prime minister. His party, the CPI(M), told that it cannot happen. Then they spent another couple of days simply talking among themselves and one afternoon, as if a bolt from the blue, someone shouted Deve Gowda is the PM elect.

Gowda then waited for a letter of support from the then Congress president (and prime minister under whom the Congress lost heavily in 1996) that did not come. On May 15, 1996, then president, SD Sharma, invited Atal Bihari Vajpayee to be sworn in the day after. Gowda, the Congress and everyone around protested, but Vajpayee was sworn in.

MPs from Uttar Pradesh and some other states were held at the Andhra Pradesh Bhawan with Chief Minister Chandrababu Naidu assuring that poachers will be dealt with.

Mulayam Singh Yadav’s MPs ended up relishing cuisine from the south of India and the United Front remained intact to elect the Congress party’s PA Sangma as the Lok Sabha speaker. Sangma was unanimously elected Speaker of the Lok Sabha on May 23, 1996.

It was evident, that day, that Vajpayee was not going to survive the confidence vote, scheduled for May 29. Vajpayee did not press for a vote and told the House, through the speaker, that he was going to the Rashtrapathi Bhawan to submit his resignation. He resigned after a long debate and Gowda was  sworn in as prime minister in just a couple of days.

Well. It now appears that we have come a long way. Karnataka Governor, Vajubhai Vala was not having to grope in the dark as did the then president, SD Sharma. He was informed, as early as before sunset on May 15, 2018 that HD Kumarasamy commanded support of 116 MLAs and a little later by Yedyurappa that he had 104 MLAs with him — this was even before the Election Commission declared the results formally.

Even while the governor waited, the media got busy reporting cases of MLAs gone ‘missing’. The BJP leaders who had announced their capture of Karnataka (thankfully not in the same way as erstwhile kings did in the past by setting fire to the captured kingdoms or in the way the BJP did in Tripura by pulling down statues) ended up calling the Congress-JD(S) agreement amoral.

The Congress, meanwhile, seem to have decided against taking any chances. Abhishek Manu Singhvi had the draft Writ Petition ready during the day on May 16 and the governor’s late night invite to Yeddyurappa to be sworn in, violating the law as laid down by the Supreme Court in the Rameshwar Prasad case of 2006, shows that the Congress leadership knew what was cooking in the Raj Bhawan in Bengaluru.

The party, once again, acted with such speed and contrast this with May 1996. A mid-night knock at the portals of justice and the swearing in allowed with conditions. For the first time in our short history indeed.

What lies next can be partly a presumption and partly conditioned by political convictions.

  1. It is likely that the Supreme Court, when it hears the writ petition on May 18 declares the Governor’s action inviting Yeddyurappa illegal and, thus makes the swearing in null and void.
  2. It is also likely that the Supreme Court lets a few days of filibuster and the chief minister ‘manages’ the numbers.
  3. The apex court may also order a floor test earlier than the fortnights time the governor has sanctioned and also have it monitored by its officers.

In the event of any of these, the assembly will be called to meet, the House will have to elect the speaker (the first business after the members are sworn in) and the Congress-JD(S) coalition fields its own candidate for the chair and either he/she is elected unanimously (as it happened in 1996 in the Lok Sabha with Sangma) or he/she defeats the BJP candidate in that.

This will ensure that the Congress-JD(S) MLAs are not poached by the BJP because the Assembly speaker will then be able to ‘deal’ with such renegades in accordance with the Tenth Schedule of the Constitution.

Well, in case the BJP manages to get its own speaker elected, which is possible only if Congress-JD(S) MLAs defect by then, the game is up insofar as Karnataka is concerned.

The field, however, is open even then for a realignment before May 2019. All that will be matter is whoever commands the resources from the state where the Kolar Gold Fields used to have gold reserves until some years ago. The gold reserves may have depleted. But mother earth, in Karnataka, has a lot more to give to those who are in game to exploit.

In any case, as of now, on May 18, 2018, we are closer to where India was taken to a couple of hours before midnight on June 25/26, 1975.

BS Yeddyurappa, BJP’s legislature party leader, took oath as the Karnataka chief minister on Thursday hours after the Supreme Court declined to stay his swearing-in ceremony.

Governor Vajubhai Vala administered the oath of office and secrecy to Yeddyurappa at 9 am at the Raj Bhavan amid tight security.

Yeddyurappa, 75, took the oath in Kannada in the presence of party’s central and state leaders and its newly-elected legislators and senior officials.

Earlier, a three-judge bench of the apex court rejected a joint writ petition of the Congress and the Janata Dal-Secular (JD-S) to stall the swearing-in of Yeddyurappa as the Chief Minister at a special pre-dawn hearing.

The top court, however, said the swearing-in of Yeddyurappa was subject to the final outcome of the matter before it and posted the case for further hearing at 10.30 a.m. on Friday.

The bench, headed by Justice AK Sikri, also sought the letter Yeddyurappa wrote to the Governor on Wednesday informing him his election as the Bharatiya Janata Party’s legislature party leader in Karnataka.

He was elected for the eighth time from the Shikaripura assembly segment in Shivamogga district of the Malnad region on May 12 when polling was held in 222 constituencies across the state and results were declared on Tuesday.

This is the third time Yeddyurappa took oath as the Karnataka Chief Minister, a decade after he became the BJP’s first Chief Minister in south India in May 2008 when the party came to power for the first time in Karnataka.

He was sworn-in for the first time as the chief minister in October 2007 as the party’s leader in the JD-S-BJP coalition government that lasted for over a month, resulting in President’s rule from November to April and mid-term assembly elections in May 2008.

Slamming Governor Vajubhai Vala’s invite to B S Yeddyurappa to form the government, JDS leader H D Kumaraswamy accused the Narendra Modi government of misusing Constitutional institutions.

“We will not let it go easily…”, a furious Kumaraswamy told reporters shortly after the governor wrote to Yeddyurappa asking him to take oath as chief minister tomorrow and to prove majority in the assembly in 15 days.

Kumaraswamy said the governor should have given three or four days time for Yeddyurappa to prove his majority.

“He (Yeddyurappa) has no majority,” Kumaraswamy said.

The JDS leader, who has also staked claim to form the government with the support of Congress, alleged that various allurements were being offerd to the MLAs to switch sides.

“It will be a repeat of 2008…they will loot the state,” he said, referring to the then BJP rule and citing the mining baron Reddy brothers.

Asked about the next step, he said, “wait and see.”

BJP General Secretary Muralidhar Rao has said Yeddyurappa will take oath tomorrow at 9 AM.

After Karnataka Governor Vajubhai Vala on Wednesday invited BJP legislative party leader BS Yeddyurappa to form the new government in the state, the Congress approached Supreme Court Chief Justice Dipak Misra for an urgent hearing on the matter.

The Congress urged Misra to hold an urgent hearing Wednesday night itself since Yeddyurappa is slated to take oath as chief minister at 9 am tomorrow.

Congress leader Abhishek Singhvi is the leading his party’s challenge.

“We have filed a petition before the Supreme Court and have urged the registrar to allow hearing on it tonight itself,” Singhvi told PTI, adding that immediate hearing has been sought as the matter is very serious.

The Congress termed the governor’s decision as “murder of democracy and trampling of Constitution”.

“We hope Governor will take the correct decision according to Constitution. If Congress-JD(S) combine is not called, it will be illegal. We hope politics will not trump legality and morality. If it does, we have no option but to move court,” Singhvi  told CNN News18.

The Congress said the Governor denigrated his office, trampled the Constitution and acted as a BJP puppet.
