Three situations when Scheduled Castes can sell land to other communities

Summary

The minimum limit of landholding is 3.5 acres in other parts of the country. If a person from the Scheduled Castes has that much land, they can sell a part of their holding to people from other communities.

A person from the Scheduled Castes cannot sell land to people from other backward classes (OBC) or those from the General category without permission from the District Magistrate.

Dr Lal Krishna, the officer on special duty (OSD) at the Bundelkhand Industrial Development Authority, emphasised that these rules are in place to protect the land from being unjustly taken away from people of Scheduled Castes, ensuring their security and rights.

Dr Lal Krishna explained that the district magistrate may consider some exceptions to the rule.

For instance, if someone in the family of the property seller is seriously ill and requires immediate medical treatment, they can sell their property. However, this requires presenting the necessary documents and an estimate of hospital expenses.

Similarly, if a person does not have any heirs, they can sell their property to a person in General category.

To sell their assets to other communities, the seller (from the Scheduled Castes) must have at least 5 acres of land in Bundelkhand.
