₹1 lakh fine for an appeal to allow Kejriwal to run Delhi government from jail

The Delhi High Court dismissed a PIL with ₹1 lakh fine for seeking appropriate arrangements for Chief Minister Arvind Kejriwal to run the government of Delhi from jail. Kejriwal has been accused of money laundering in a case linked to the alleged Delhi excise scam.

The petitioner also sought to restrain Delhi BJP president Virendra Sachdeva from exerting any “undue pressure” for the resignation of Kejriwal.

A bench headed by Acting Chief Justice Manmohan observed that since the AAP leader has already approached the Supreme Court against his arrest, “no orders were called for” with regard to providing him any facilities while in judicial custody.

he bench, also comprising Justice Manmeet PS Arora, further said the court cannot impose censorship on the media or stop political rivals from making statements. “Do we impose emergency? We impose censorship? We impose martial law? How do we gag the press? The political rivals?” the court said.

“Keep bank draft of Rs 1 lakh ready,” the court told the petitioner.

Kejriwal was arrested on March 21 and is currently lodged in Tihar Jail under judicial custody. The matter relates to alleged corruption and money laundering in the formulation and execution of the Delhi government’s now-scrapped excise policy for 2021-22.

On May 7, the Supreme Court did not grant an interim bail to Kejriwal and posted the matter for May 9.  During the hearing, the court cleared that Kejriwal cannot perform any official duties if released on interim bail.

On April 9, the High Court upheld Kejriwal’s arrest, saying there was no illegality and the ED was left with “little option” after he skipped repeated summonses and refused to join the investigation.
